- Eligibility: This Raffle is open to all Davis and Shirtliff Limited’s registered stockists (The Stockists), as of the date of entry. Employees of Davis and Shirtliff Limited, its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the “Employees”), and immediate family members and/or those living in the same household of Employees are NOT eligible to participate in this Raffle. The Raffle is subject to all applicable national and local laws and regulations. Void where prohibited.
- Agreement to Rules: By participating, the Contestants (“You”) agree to be fully and unconditionally bound by these Rules, and they represent and warrant that they meet the eligibility requirements. In addition, they agree to accept the decisions of Davis and Shirtliff Limited as final and binding as it relates to the content of this Raffle.
- Raffle Period: Raffle virtual tickets will be allocated to The Stockists starting on 30th November 2021, and the winner(s) will be announced on or before 15th December 2021, 23:59 EAT.
- Raffle Administration: The Raffle virtual tickets will be allocated based on revenues posted by The Stockists from 1st December 2020 to 30th November 2021. The final allocations will be at the sole discretion of Davis and Shirtliff Limited’s Management Team.
- Prizes: The Winner of the Raffle (the “Winner”) will receive a Toyota Probox vehicle, aptly branded by Davis and Shirtliff Limited. The 1st and 2nd Runners Up (the “1st Runner Up” and the “2nd Runner Up”) will be eligible to receive branded Davis and Shirtliff merchandise which includes an assortment of Polo Shirts and T-Shirts. The specifics of the prizes shall be at the sole discretion of Davis and Shirtliff Limited’s Management Team. The prizes are not transferable.
- Use of Title: Acceptance of prizes constitutes permission for Davis and Shirtliff Limited to use Winner’s and Runner’s Up official stockist shop names, likeness, and entry for purposes of advertising, trade and public relations, without further compensation unless prohibited by law.
- Winners Selection and Notification: Winners will be selected by Davis and Shirtliff Limited’s Management Team, based on random picking of 3 Raffle virtual tickets, in the order of “2nd Runner Up”, the “1st Runner Up” and the “Winner”, in that order. The Winner will be notified via direct communication, a circular targeted at all The Stockists, our website and our News Letter. Davis and Shirtliff Limited shall have no liability for “Winner”’s failure to receive notices due to spam, junk e-mail, etc. Receipt by the “Winner” and the “Runners Up” of the prizes offered in this Raffle is conditioned upon compliance with any and national and local laws and regulations.
- ANY VIOLATION OF THESE OFFICIAL RULES BY THE “WINNER” AND THE “RUNNER’S UP” (AT DAVIS AND SHIRTLIFF LIMITED’S SOLE DISCRETION) WILL RESULT IN DISQUALIFICATION FROM THE RAFFLE, AND ALL PRIVILEGES WILL BE IMMEDIATELY TERMINATED.
- Rights Granted by You: By virtue of being a Davis and Shirtliff Limited Stockist, that is, you The Stockist understand and agree that Davis and Shirtliff Limited or anyone acting on behalf of Davis and Shirtliff Limited, either as licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your raffle entry, official stockist shop name, portrait, picture, voice, likeness, image, statements about the Raffle, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent.
- Terms & Conditions: Davis and Shirtliff Limited reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Raffle should virus, bug, non-authorized human intervention, fraud, or other cause beyond Davis and Shirtliff Limited’s control corrupt or affect the administration, security, fairness, or proper conduct of the Raffle. In such cases, Davis and Shirtliff Limited may select the “Winner” from all eligible Raffle virtual tickets received prior to and/or after (if appropriate) the action taken by Davis and Shirtliff Limited. Davis and Shirtliff Limited reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Raffle or violates these Terms & Conditions. Davis and Shirtliff Limited has the right, in its sole discretion, to maintain the integrity of the Raffle in any manner that it chooses.
- Limitation of Liability: By virtue of being a Davis and Shirtliff Limited stockist, The Stockist is automatically entered into the Raffle and therefore agrees to release and hold harmless Davis and Shirtliff Limited and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from:
- such entrant’s participation in the Raffle and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof;
- technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment;
- the unavailability or inaccessibility of any transmissions, telephone, or Internet service;
- unauthorized human intervention in any part of the entry process or the Raffle;
- electronic or human error in the administration of the Raffle or the processing of entries.
- Disputes: This Raffle is governed by the laws of Kenya, without respect to conflict of law doctrines. As a condition of participating in this Raffle, participant agrees that any and all disputes that cannot be resolved between the parties and causes of action arising out of or connected with this Raffle, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Kenya having jurisdiction. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Raffle). Participant further waives all rights to have damages multiplied or increased.
